Work Place Injuries - Know Your Legal Rights
Whether you work in an office, a factory, a hospital or a construction site, it is important to know your legal rights. The modern work place can be dangerous. Workers can suffer injuries on the job from slipping, tripping, dangerous machinery like wood chippers, slicers or presses or equipment like scaffolds and ladders. Unfortunately employers often expose workers to danger by skimping on safety devices and by ignoring safety regulations.
Over the last 25 years our Brooklyn Work Injury Lawyers have brought many successful lawsuits on behalf of seriously injured workers. For example, we recently concluded a multi-million dollar case on behalf of an airport baggage handler who was sucked into an unguarded overhead conveyor belt. Our client suffered multiple broken bones in his arm and shoulder, as well as broken ribs, and required a saphenous vein bypass graft to repair a damaged artery. After extensive investigation and legal proceedings we were able to demonstrate that one of the defendants had failed to replace a necessary safety guard and other defendants had permitted the existence of dangerous work practices.
We were able to obtain another multi-million dollar payment on behalf of a mechanic who was burned over 40% of his body when a portable oil transfer tank, with defective safety labeling, exploded into flames. In this case we consulted with a professor of engineering, an economist and a vocational rehabilitation expert to obtain a favorable result for our client.
One of the most horrible cases that we were involved in concerned a young man working as a tree pruner who was pulled into a diesel powered commercial wood chipping machine when his arm became tangled in branches that were being fed into the machine. The machine had a defectively designed safety control and the young man would have been completely sucked in by the hydraulic feed and chopped into pieces if a co-worker had not heard his screams. Although the young man’s life was spared, his right hand was cut off on a diagonal leaving him with only a pinky finger. His shoulder and elbow joints were also badly damaged from trying to hold on to the machine while the hydraulic feed slowly pulled him into the grinding wheel.
Other cases that we have successfully handled for injured workers have involved a medical technician’s exposure to excessive radiation causing cancer years later, scaffold falls and collapses, falling scissor lifts and cherry pickers, improperly repaired fork lifts, and improperly guarded and labeled table saws.
